The capitalized terms used in these Terms and Conditions shall have the following meanings:
These Terms and Conditions set out the rules and conditions for using the website available at: https://promatic.pl.
These Terms and Conditions constitute the terms for the provision of electronic services referred to in Article 8 of the Polish Act on the Provision of Electronic Services, and they define the conditions for providing such services through the Website, the conditions for concluding and terminating agreements for the provision of such services, as well as the complaint-handling procedure.
The Website available at: www.promatic.pl is operated by PROMATIC sp. z o.o., with its registered office in Warsaw at ul. Przyokopowa 33, 01-208 Warsaw, registered in the Register of Entrepreneurs of the National Court Register under number 0000661216, whose registration files are kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, holding NIP (Tax Identification Number): 6112774017, REGON (National Business Registry Number): 366476880, with a share capital of PLN 700,000.00.

As part of its business activities, PROMATIC provides the following electronic services via the Website:
a. access to content published on the Website,
b. Contact Form,
c. Newsletter.
Information regarding Products available on the training platform, including their descriptions, technical and functional specifications, and prices, constitutes an invitation to conclude a contract for the supply of a Product within the meaning of Article 71 of the Polish Civil Code.
The Terms and Conditions are made available free of charge via the Website, enabling the User to access, reproduce and store the content of the Terms and Conditions using the IT system they employ.
The Terms and Conditions constitute a template of a distance contract. When using the Services referred to herein, the content of the Terms and Conditions forms the content of the agreement concluded between the parties for the provision of electronic services.
Before using the Services, the User is required to read the Terms and Conditions. In addition, before using Services such as the Contact Form and the Newsletter, the User must accept the provisions of the Terms and Conditions and the Privacy Policy by selecting the appropriate checkbox.
The User is obliged to use the Services in accordance with applicable law, these Terms and Conditions, and good practices. In particular, information provided by the User, including information submitted through forms made available on the Website, must be truthful. The User bears full responsibility for the correctness and accuracy of the information they provide. The User is solely responsible for the data provided, including any liability for infringements of third-party rights. The User should update any data that has changed if such updates are necessary for the continued provision of Services.
Proper use of the Services by the User requires:
a. an Internet connection;
b. possession of devices enabling the use of Internet resources;
c. use of an Internet browser (Microsoft Internet Explorer version 8.0 or higher, Mozilla Firefox version 3.0 or higher, Opera version 9.0 or higher, Google Chrome version 6 or higher) that allows the display of hypertext documents linked on the Internet through the WWW service, supports the JavaScript programming language and accepts cookies;
d. possession of an active email account;
e. possession of software enabling the reading of files in .pdf, .docx or .xlsx format.
The User shall bear the costs of meeting the above technical requirements necessary to use the Services.
PROMATIC is not responsible for the User’s failure to meet the technical requirements necessary to use particular Services.
PROMATIC informs that it uses cryptographic protection for electronic transfer and digital content through the application of appropriate logical, organizational and technical measures, in particular to prevent unauthorized third-party access to data, including SSL encryption, access passwords, antivirus software and anti-malware solutions. Despite these safeguards, the use of the Internet and electronic services may pose a risk of harmful software accessing the User’s IT system or device, or of unauthorized access to data stored on such device by third parties. To minimize these risks, it is recommended that the User’s device additionally has:
a. up-to-date antivirus software,
b. an effective security firewall,
c. all available operating system and browser security updates installed,
d. enabled cookies acceptance and JavaScript functionality in the Internet browser.
The User is prohibited from providing unlawful content while using the Services, including using viruses, bots, worms or other computer codes, files or programs (in particular those that automate scripts or application processes, or other codes, files or tools).
To the fullest extent permitted by law, PROMATIC shall not be liable for disruptions, including interruptions in the provision of Services, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Services with the User’s technical infrastructure.
PROMATIC exercises the highest level of diligence to ensure that the Services are provided at the highest standard; however, temporary suspension of Service availability may occur when necessary to conduct maintenance, inspections, upgrades or expansion of the Website. PROMATIC will make efforts to ensure that planned technical interruptions related to maintenance of the software, telecommunications equipment and servers used for the Website are, where reasonably possible, scheduled during night-time hours.
Any User may use the Service, provided that the required technical conditions are met.
The User may access and review all content published by PROMATIC on the Website free of charge.
The Service is provided 24 hours a day, 7 days a week, subject to technical interruptions necessary for maintenance work or other situations specified in these Terms and Conditions.
The agreement for the provision of the Service is concluded for the duration of the User’s actual use of the Website and is deemed concluded each time the User accesses the Website.
The agreement is terminated upon the User leaving the Website, without the need for any additional declarations by either PROMATIC or the User.
PROMATIC exercises due diligence to ensure that the content published on the Website is reliable and up to date; however, it accepts no liability for the User’s use of such content in a manner inconsistent with its informational purpose.
Any User may use the Service, provided that the required technical conditions are met.
The Service is provided 24 hours a day, 7 days a week, subject to technical interruptions necessary for maintenance work or other situations specified in these Terms and Conditions.
The Contact Form Service is provided by PROMATIC free of charge and solely for the purpose of responding to the User’s inquiry.
The agreement for the provision of the Contact Form Service by electronic means is concluded for a fixed period and terminates once PROMATIC provides a response to the User’s inquiry submitted via the Contact Form. The agreement is deemed concluded at the moment the User clicks the “Send” button (link), after correctly completing the Contact Form by providing the required data (email address or telephone number), entering the inquiry content, selecting the preferred method of contact, and submitting a declaration of having read and accepted the Terms and Conditions and the Privacy Policy by selecting the appropriate checkbox.
PROMATIC will respond to the User’s inquiry submitted via the Contact Form using the email address or telephone number provided in the form, within up to 7 business days where reasonably possible. PROMATIC shall not be liable for any failure to meet this timeframe.
The Contact Form may only be used for correspondence related to PROMATIC’s business operations, including inquiries regarding the offer, scope of services provided, and available products.
It is prohibited for the User to provide false personal data or to provide personal data of another person without their consent, including email addresses or telephone numbers that the User does not own. The User bears sole responsibility for the data they submit, including any liability for potential infringement of third-party rights.
Any User may use the Service, provided that the required technical conditions are met.
The Newsletter Service is provided on a recurring basis.
The Newsletter Service is provided free of charge.
The agreement for the provision of the Newsletter Service by electronic means is concluded for an indefinite period and terminates upon its cancellation. The agreement is deemed concluded at the moment the User orders the Service by clicking the “Subscribe” button (link), after providing their email address, giving consent to the processing of personal data for the purpose of using the Newsletter Service, submitting a declaration of having read and accepted the Terms and Conditions and the Privacy Policy, and giving consent to direct marketing and the sending of commercial information—by selecting the appropriate checkbox.
Provision of the Newsletter Service requires the User’s consent to receive the PROMATIC Newsletter, meaning commercial and marketing information regarding PROMATIC’s business activities, including services, products, and events included in the content of the Newsletter, sent by electronic mail to the email address provided in the form. This requirement implements the legal obligations arising from applicable law, in particular the Polish Electronic Communications Act of 12 July 2024.
The agreement for the provision of the Newsletter Service is concluded for an indefinite period until the User unsubscribes from receiving the Newsletter, which is equivalent to terminating the agreement for the provision of the Newsletter Service with immediate effect. The User may unsubscribe from the Service at any time, without providing a reason.
The User may unsubscribe from the Newsletter via the unsubscribe link included in each Newsletter message or by submitting an appropriate statement of resignation to the following email address: newsletter@promatic.pl.
Each User may submit notifications and complaints regarding all Services provided electronically through the Website in accordance with these Terms and Conditions, including by filing a complaint:

b. by email to: info@promatic.pl,
c. by telephone at: +48 75 76 78 007, available Monday to Friday from 8:00 a.m. to 4:00 p.m.
Notifications and complaints should include a description of the incident or issue that is the subject of the notification or complaint, as well as contact details of the person submitting it, enabling PROMATIC to provide a response.
PROMATIC will review each User’s notification/complaint and inform the User of the manner in which the complaint has been resolved within 14 days from the date of receiving all information necessary to process it.
In particularly complex cases that prevent the notification or complaint from being processed within 14 days, PROMATIC reserves the right to extend the complaint-handling period to 30 days. In such a case, PROMATIC will inform the User of the extension and the reason for the delay before the original 14-day period expires.
The content made available on the Website, including: text, graphics, logos, icons, images, photographs, audio files, videos, data files, presentations, software, and any other data or materials provided to the User as part of the electronically supplied Services (hereinafter referred to as “Content”) is protected by intellectual property rights. Economic copyrights to the Content belong to PROMATIC or to entities with whom PROMATIC has concluded appropriate agreements, while moral rights belong to the authors. If the Content includes images of persons, such materials are additionally protected as personal rights. No part of the Content may be copied or distributed in any form or by any means without prior written permission from PROMATIC.
The conclusion of an agreement for the provision of Services by the User does not result in the transfer of ownership or any intellectual property rights to the Content.
The User may use the Content solely for their own needs and within the limits permitted by law. In particular, the User is prohibited from:
a. removing security features or markings placed on the Content,
b. reproducing or distributing the Content, whether in printed or electronic form,
c. making the Content available to third parties, whether in printed or electronic form,
d. renting or lending the Content, whether in printed or electronic form.
The User shall be liable for damages for any actions inconsistent with the provisions of this section of the Terms and Conditions.

PROMATIC may amend these Terms and Conditions in the event of:
a. changes to PROMATIC’s corporate data;
b. changes to the scope of PROMATIC’s business activities;
c. the introduction of new services by PROMATIC, modification of existing Services, or discontinuation of their provision;
d. a legal obligation to implement changes, including the obligation to adapt the Terms and Conditions to applicable law.
Users will be informed of any amendments to the Terms and Conditions by the publication of the updated version on the Website.
In matters not regulated by these Terms and Conditions, generally applicable provisions of law shall apply.
The invalidity of any provision of these Terms and Conditions shall not affect the validity of the remaining provisions.
These Terms and Conditions do not exclude or limit any rights granted to the User under mandatory provisions of law. In the event of any inconsistency between the Terms and Conditions and mandatory provisions of law granting specific rights to the User, such provisions of law shall prevail.
Failure by PROMATIC to enforce any right arising under these Terms and Conditions or failure to exercise rights granted under generally applicable law shall not be deemed a waiver of such rights, and such conduct shall not affect PROMATIC’s rights arising from these Terms and Conditions or from applicable law.
The governing law for these Terms and Conditions and for the agreements referred to herein is Polish law.
The current version of the Terms and Conditions is effective as of 30 September 2025.
